Terms of Use

This is an English translation for convenience. The Korean version prevails; if the two differ, the Korean version applies.

  • Effective date: October 1, 2026

Article 1 (Purpose)

These terms set out the rights, obligations and responsibilities of BzEngage (the "Company") and Members, and other necessary matters, regarding the use of the BzAnalytics cloud service the Company provides (the "Service", https://bzanalytics.co).

Article 2 (Definitions)

  1. Member: an individual who agrees to these terms, creates an account and uses the Service, or the corporation or organization that individual belongs to.
  2. Customer: an organization (tenant) a Member creates in the Service, together with all Members belonging to it.
  3. Source: a website, app, server or webhook a Customer registers in the Service to collect data.
  4. Analytics data: the data a Customer sends to the Service by installing collection code (tracking snippet, app SDK, API, webhook) on a Source, and the aggregates and analysis results the Service makes from it.
  5. End User: a person who uses a Customer's website, app or the like and whose usage records are collected as analytics data.

Article 3 (Posting and amendment of the terms)

  1. The Company posts these terms in the Service.
  2. The Company may amend these terms to the extent that it does not violate applicable laws. It gives notice of an amendment from 7 days before the effective date, and of an amendment unfavorable to Members from 30 days before the effective date, in the Service and by email.
  3. A Member who does not agree to the amended terms may terminate the service contract. A Member who does not express refusal by the notified effective date is deemed to have agreed. The Company states this when it gives notice.

Article 4 (Formation of the service contract)

  1. The service contract is formed when an applicant agrees to these terms and to the collection and use of personal information, applies to sign up, and the Company accepts (completion of email verification).
  2. The Company may refuse acceptance, or later terminate the contract, in the following cases.
    • The application uses another person's information
    • The application contains false information
    • The application is made for the purpose of violating laws or these terms

Article 5 (Account management)

  1. A Member must keep the account and password safe and must not let a third party use them.
  2. If an account has been, or is suspected to have been, stolen, the Member must inform the Company immediately.
  3. The owners and administrators of a Customer are responsible for inviting members, assigning roles and removing access within the organization.

Article 6 (Provision and changes of the Service)

  1. The Company provides web analytics, app analytics, event analytics, dashboards, reports, notifications, AI analytics features and the like. The specific features are as shown in the plans and in the Service.
  2. The Company may add or change features to improve the Service. Important changes unfavorable to Members are notified in advance as in Article 3 (2).
  3. The Company may suspend the Service temporarily in unavoidable cases such as inspection or replacement of equipment, outages or natural disasters. Planned suspensions are notified in advance.

Article 7 (Fees and payment)

  1. The fees of paid plans, the included limits (pageviews, number of sources, retention period and the like) and the usage period are as shown on the pricing screen and in the quotation issued by the Company.
  2. A Member applies for a paid plan through the inquiry contact (admin@bzanalytics.co). The Company issues a tax invoice, and the Member pays by bank transfer to the account the Company provides. The Company applies the plan after confirming the payment. The Service does not offer instant payment by card or similar means on its screens.
  3. If the Member does not apply for an extension before the usage period ends, the account changes to the free plan after the period ends. The Company gives notice before the period ends.
  4. Refunds follow the applicable laws and the criteria in the quotation and pricing information issued by the Company. If the Company fails to provide the Service due to its own fault, it refunds that period or extends the usage period accordingly.
  5. When fees change, the Company gives notice 30 days before the effective date, and the new fees apply from the following usage period.

Article 8 (Obligations of Members)

  1. Members must not do the following.
    • Violate laws or these terms
    • Use another person's information without authorization
    • Interfere with the normal operation of the Service (excessive requests, exploiting vulnerabilities, reverse engineering and the like)
    • Resell the Service without the Company's approval
    • Collect personal information without informing End Users or without obtaining the necessary consent
  2. Members must not send sensitive or unique identification information, such as resident registration numbers, account or card numbers or health information, through the collection code. The Service masks some formats automatically, but Members must not rely on that feature to send such information.
  3. Members must keep the Service's credentials (API keys, server collection keys, webhook signing secrets and the like) safe and, if they leak, revoke and replace them immediately.

Article 9 (Analytics data and entrustment of personal information processing)

  1. The rights to analytics data belong to the Customer. The Company processes analytics data only to the extent needed to provide the Service, and does not use it for other purposes or provide it to third parties.
  2. Where analytics data includes End Users' personal information, the Customer is the personal information controller and the Company is the trustee that processes it on the Customer's behalf. This article forms the content of the entrustment contract under Article 26 of the Personal Information Protection Act.
    • Entrusted work: collecting, storing, aggregating and analyzing analytics data and providing the results
    • Restriction of processing: the Company does not process it for purposes other than the entrusted work.
    • Safety measures: as in section 12 of the privacy policy.
    • Re-entrustment: the Company re-entrusts only to the trustees listed in section 7 of the privacy policy, and gives prior notice when it changes them.
    • Management and supervision: the Customer may ask the Company for materials on the state of processing.
    • Return and destruction: when the contract ends or the Customer deletes a source or organization, the data is destroyed without delay. The Customer may receive the data beforehand through the export features.
    • Damages: if the Company violates this article and damage results, the Company compensates for it.
  3. Customer's obligations: the Customer must state the use of BzAnalytics and the entrustment in the privacy policy of its own service, and obtain End Users' consent where necessary — in particular when it uses the "persistent" or "identified" visitor identification method. The Customer handles End Users' requests to exercise their rights, and the Company provides features that help (exporting and deleting visitor data).
  4. For improving the Service and for statistics, the Company may make and use usage statistics of the Service (frequency of feature use, error rates and the like) in a form that cannot identify a specific Customer or individual. It does not use the content of analytics data itself.

Article 10 (AI analytics features)

  1. The AI analytics features go through AI processing by Anthropic, PBC (USA) with the Customer's own Anthropic API key that the Customer has registered for a workspace. That processing is governed by the contract between the Customer and Anthropic, and its usage fees are charged to the Customer's Anthropic account. In a workspace without a registered key, no external AI is called and rule-based results are provided.
  2. The Company passes on the requests at the Customer's instruction. Not raw events but only aggregated or masked values are sent, according to the transfer policy the Customer sets; personal information, identifiers and event property values are not sent.
  3. Answers, summaries and recommendations made by AI are for reference. Their accuracy or fitness for a particular purpose is not guaranteed, and they should be checked against the original data before important decisions.
  4. The Customer can turn the AI features off, or delete a workspace's AI key, in the organization or workspace settings.

Article 11 (Termination and deletion of data)

  1. A Member may leave at any time in the account settings. The owner of an organization may delete the organization; all workspaces, sources and analytics data of that organization are then deleted.
  2. If a Member seriously violates Article 8, the Company may restrict use or terminate the contract after prior notice. In case of an urgent security threat, it may restrict first and notify afterwards.
  3. When the contract ends, the Company destroys member information and analytics data after the periods set in the privacy policy.

Article 12 (Limitation of liability)

  1. The Company is not liable for damage caused by reasons beyond its control, such as natural disasters, causes attributable to the Member, or outages of third-party services (cloud provider and the like), unless the Company acted intentionally or with gross negligence.
  2. The Company is not liable for judgments a Member makes using analysis results obtained through the Service, or for their consequences.
  3. For paid services, the Company's liability for damages, unless it acted intentionally or with gross negligence, is limited to the total fees the Member paid the Company in the 12 months immediately before the day the damage occurred. Where applicable laws provide otherwise, those laws apply.

Article 13 (Intellectual property)

  1. The rights to the Service and its software, design and documents belong to the Company.
  2. The rights to data a Member uploads to the Service and to analytics data belong to the Member (Customer) (Article 9).

Article 14 (Notices)

The Company notifies Members through the email address the Member registered or through the Service. A notice to all Members may be replaced by posting it in the Service for at least 7 days.

Article 15 (Governing law and dispute resolution)

  1. These terms are interpreted under the laws of the Republic of Korea.
  2. The parties first try to resolve disputes related to the Service by consultation; where a lawsuit is needed, it is brought before the competent court under the Civil Procedure Act.

Addendum

These terms take effect on October 1, 2026.
